CBJ updates regulations on “grandfathered” structures

The City and Borough of Juneau’s Land Use Code has recently been updated with new regulations that establish a process for nonconforming situations to be certified. Nonconforming situations are existing uses, structures, or lots that were legally established prior to a change in zoning provisions, which do not comply with current zoning regulations. They are commonly referred to as “grandfathered.” The update to the Nonconforming Situations chapter of the land use code, CBJ 49.30, went into effect April 15.

During the development process, the CBJ Community Development Department received valuable feedback from local citizens and businesses. All comments were evaluated and many were incorporated into the final ordinance.

The certification of nonconforming situations is expected to ease sales of nonconforming situations. A Nonconforming Certificate may be acquired at any time. Property owners are encouraged to seek a Nonconforming Certificate for their property prior to listing it for sale.
